Please read these Terms and Conditions ("Terms") carefully before using our service ("Service"). These Terms govern your relationship with Wickedly Dynamic Designs as a user ("User" or "you") of the Service. By accepting a proposal, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services we provide.

 

Intellectual Property Rights

 

All intellectual property rights, including copyright and trademarks, in the logo designs created by Wickedly Dynamic Designs shall remain the property of Wickedly Dynamic Designs unless otherwise agreed upon in writing. Upon the User's full payment for the logo/ packages, Wickedly Dynamic Designs grants the User a non-exclusive, non-transferable license to use the logo design and package for the User's intended purpose. This only applies once PAID IN FULL. Any pending invoice or incomplete payments of the service(s) void use of the products and design in all capacity.

 

User Obligations

 

By using the Service, you agree to provide accurate and complete information regarding your logo design requirements. You acknowledge that any delay or failure to provide necessary information may affect the quality and timely delivery of the logo design. You also agree not to submit any content that infringes upon the intellectual property rights of third parties. It is the clients due diligence to make sure any and all content provided is free of infringement.

 

Payment and Pricing

 

Payment for the logo design service shall be made in two steps according to the agreed-upon terms and methods. A minimum 50% deposit is required for all custom work, and is non-refundable. If having items printed, the remaining balance is due upon final approval before sent to the printing house. If having digital items the remaining balance is due before the files are released. Printed items are final sale. If there are any quality concerns please reach out with images and time stamps for Wickedly Dynamic Designs to follow up with the printing and shipping. It is up to the sole discretion of Wickedly Dynamic Designs if product received is up to standard, and/or any resolution options that may be provided.

 

Revisions and Refunds

 

Additional revisions may be requested by the user, it is up to the discretion of the Wickedly Dynamic Designs design team if requests can or will be honoured and if it be subject to an additional fee. Refunds will not be provided on any deposits. Deposits are deemed final. Custom Work is NON-REFUNDABLE.

 

Confidentiality

 

Wickedly Dynamic Designs will treat all information provided by the User as confidential. Wickedly Dynamic Designs will not disclose any confidential information to third parties, except as required by law or with the User's consent.

Limitation of Liability​

To the fullest extent permitted by law, Wickedly Dynamic Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Service. In no event shall Wickedly Dynamic Designs total liability exceed the total amount paid by the User for the service.​

 

 

Termination​

 

Wickedly Dynamic Designs may terminate or suspend the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms by the User. Upon termination, the User's right to use the Service will cease immediately. This applies to verbal/written harassment, pressuring or intimidation tactics. Wickedly Dynamic Designs reserves the right to terminate a contract for aggressive or in-appropriate behaviour.

 

Governing Law

 

These Terms shall be governed by and construed in accordance with the laws Canada. Any disputes arising out of or in connection with these Terms shall be mediated before court filings. If unable to mediate despite resolutions offered by Wickedly Dynamic Designs, the client is responsible for all court fees and disbursements accrued. Wickedly Dynamic Designs reserves the right to release all information provided by the client to the courts at that time.

 

Modifications

 

Wickedly Dynamic Designs reserves the right to modify these Terms at any time, effective upon posting the updated Terms on its website. Your continued use of the Service after any such changes constitutes your acceptance of the modified Terms. By placing a deposit you agree to the terms and conditions as set out, and will be accepted in place of a signature for approval.
